BOLI Mediator/Conciliator (Compliance Specialist 3)

BOLI has an opening for a BOLI Mediator/Conciliator (Compliance Specialist 3) position in BOLI's Alternative Dispute Resolution Unit (ADR Team) in the Legal Policy Division of the Agency. This position may be based out of BOLI's headquarters in Portland, Oregon, or in BOLI's offices in Salem or Eugene. The successful candidate may also be eligible to work a hybrid schedule.

This is a permanent, full-time, SEIU represented position. This recruitment may be used to fill additional vacancies as they occur.

What You Will Be Doing

This is a sampling of job duties. It is not meant to encompass all duties.

  • Providing high-quality dispute resolution services through mediation and/or conciliation, including full-day mediation sessions and assistance in final settlement drafting
  • Offering a safe and confidential platform for parties to communicate to reach a negotiated settlement agreement
  • Answering questions and providing information on BOLI mediation services
  • Adhering to performance standards, including time to resolution deadlines
  • Promptly communicating with parties and their counsel, as well as investigative Divisions regarding the status of mediation
  • Updating case management systems and maintaining assigned case files
  • Supporting dispute resolution through application of the Mediator/Conciliator's advanced knowledge all of the laws enforced by BOLI Civil Rights and/or the Wage and Hour Division
  • Identifying and defining issues of the dispute between the parties; applying and interpreting appropriate statutes, rules, policies, and case law to promote understanding of the underlying issues and what must be resolved
  • Managing 70-100 matters in mediation and/or conciliation per year, subject to fluctuations in referrals, complexity of cases, and individualized circumstances

Working Conditions

  • Professional office environment; regular use of laptop computer and Microsoft 365 applications.
  • Daily contact with the general public, attorneys, and others who are involved in highly sensitive situations and who may be angry, hostile, or otherwise emotionally volatile
  • Some in-state/overnight travel may be required on an infrequent basis. Travel in adverse weather conditions and during night hours may be required.
  • May require the transportation of transport laptops, large files, boxes of files and other equipment which may weigh up to 25 pounds each.
  • When engaged in conciliations and mediations, this position may require a flexible schedule or more than 8 hours of work in a day.
  • Employee may be required to use a state vehicle to conduct business; must have a valid driver's license and a good driving record or be able to provide an acceptable alternate method of transportation.
  • At times, weekend and evening work will be necessary to meet customer demands and case deadlines

This Is What You Need to Qualify

Minimum Qualifications :

  • Five years of experience doing administrative research that included compiling and evaluating facts to recommend management action, or decide compliance or eligibility with program guidelines and regulations. Three of the five years must be above the technical support level.

College-level course work may substitute for experience on the basis of 45-quarter units per year, up to a maximum of three years.

Required Skills :

  • Minimum 40-hour training and education on mediation skills and techniques
  • Serving as a mediator or participating in over 20 mediations as a party, representative and/or advocate
  • Demonstrated knowledge of Oregon employment laws
  • Professional commitment to alternative dispute resolution
  • Familiarity with different mediation styles and approaches to problem-solving in legal settings

The ideal candidate will possess the following desired skills and attributes :

  • Ability to provide high-quality mediation and conciliation services that will lead to resolution for parties
  • Knowledge of best practices to perform mediations consistent with due process principles, confidentiality rules, ethics and other laws pertinent to the fair administration of dispute resolution services at BOLI
  • Advanced and effective verbal and written communication skills
  • Experience practicing independent judgment to determine a course of action based on laws, rules, policies, and procedures
  • Ability to communicate effectively with people from a wide variety of life experiences, education levels, and communication preferences
  • Experience writing narrative reports or settlement documents sufficient for use at administrative hearings or in court
  • Experience explaining procedures and technical requirements in a tactful, clear, and concise manner
  • Preference may be given to candidates with professional competencies in Spanish, Russian, Vietnamese or other commonly used languages in the State of Oregon

  • Per the Pay Equity Law passed in 2017, a pay equity analysis will be conducted to determine what pay step the successful candidate will be offered. The analysis will be based on the relevant experience, education, training, and certifications documented in the application materials. On average, candidates new to state service will most likely be offered compensation in the lower to mid-level of the salary range.
  • The salary range listed is the non-PERS eligible rate. If you're already a participating PERS member or once you become PERS eligible after 6 months of employment, the salary range will increase by 6.95% and the required 6% employee retirement contribution will be deducted from your pay.
